Aswan Governor's Decision Nullified

On Sunday 26th of December 2004, the Aswan-based Dispute-Resolution Committee rendered a decision accepting the request submitted by the founder of the Health and Environmental Development Foundation (HEDF), Redisia, Edfo, Aswan, registered under No.616/01. The decision included the following requests:
1-Non-admissibility of article 2 of Aswan Governor's decision no.264/04 concerning his appointment of a new board of trustees on the basis that it had no legal basis.
2-The approval of the founder's decision issued on 8/11/04 concerning the appointment of a new board of trustees composed of: Gamal Mohamed Abdullah Khalil, Kamal Abdu Ahmed Azon and Gamal Abdel-Mohsen Atia Yousef.
3-Obliging the administrative body to take all necessary measures so that the founder's appointed board of trustees can conduct its prerogatives in accordance with the law and the HEDF statute, and to notify the National Bank of Egypt, Aswan Branch, and Alexandria Bank, Edfo Branch, to release the HEDF's froze accounts.
On Thursday 23/12/04 the Committee examined and considered the request and finally reached a decision to be released today Sunday.
The request was impeaching article 2 of Aswan Governor's decision no.264/04 concerning the appointment of a new board of trustee for the HDED in Redisia, as according to the resolution no.22/2003 by the minister of social affairs, governors are not legally assigned to appoint board of trustee to any institutes.
The request also strengthened on article 60, law no.84/2002 , which states that the board of trustee can be appointed only by the founder of the institution or according to its main system. so neither the ministry of foreign affairs nor the Governor are authorized to interfere, unless was impossible to be appointed by it is main system.
