New Trial for the former Chilean Dictator Pinochet

20th of December 2004

Chilean Judge Juan Gosman Tabia declared that Ogusto Pinochet, the former chilean dictator, is officially accused of all crimes intended to eliminate all leftist dissidents in Chile during his dictatorial Age from 1973 till 1990, after Pinochet's Coup D'etat against Salvador Allende. Judge Tabia explained that the 89 years old Pinochet enjoys a mental state that would enable him to attend the trial as he "was able to use Logic in understanding the questions and connecting them to proper answers during his last interrogation on the 25th of September". This decision comes as result of the Chilean army' confessions, for the first time, about militants involved in Human Rights violations during Pinochet's dictatorial age. at the same time that President Ricardo Lagos and the government revealed a prolonged Dictatorial Torture report .

Judge Gosman added that Pinochet is accused of the Condor Case; where seven victims were detained, murdered and their bodies are not found till now.

The Condor was an elimination operation aimed at all Dictatorial-antagonists in Latin America(Argentine, Bolivia, Brazil, Chile, Paraguay and Uruguay) During the Seventies. Families of the victims expressed their happiness and relief to such accusation," When there is a will to investigate all Legal files that been stored in courts for over thirty years, I think there is a possibility to trial all world dictators " said Viviana Diaz, director of the "Collective of lost prisoners' families"

General Pinochet is under house arrest at his house in Dehisia, in the east side of Chile. In February and March2001, same Judge suspended Pinochet for six weeks for masterminding the (Death Troop); a military force spread in Chile in 1973, only one month after Pinochet was elected, specialized in murder and kidnapping.

Not only that, but Pinochet was De-immunized by the constitutional Court in Santiago in December, for murdering General Carlos Brates and his wife Sofia Cotepiret in September 1974. Late Nineties, Pinochet was arrested by the British authorities, due to an extradition warrant requested by the Spanish Judge Pelistar Garzon. Then Spain, Belgium, France and Switzerland officially requested to be handed Pinochet.

But The Former Dictator, who thought that the life-time sovereign immunity granted by his own government might just help him to escape all accusations of inhuman violations he committed, appealed twice as former presidents are not to be handed to any other country. But the British house of Lords, refused both appeals and declared that " crimes against humanity could not be considered as the normal acts of a head of state; only actions of the state brought immunity with them "

Pinochet's trial is hoped to be the first of judging all dictators, in the Arab region and all around the world.
