HRINFO: Stop questioning MECA( Middle East Christians Association) The two accused must stand before a court of justice
Cairo, 19th August, 2007
HRINFO urged the general attorney today to appoint a judge to continue questioning the two accused from MECA. The unlawful measures taken by the deputy of state security against the accused mar the questioning process with bias and lack of transparency.
The two accused," Adel Fawzy and Peter Ezzat", were arrested on Wednesday 8th August and stood before the deputy of state security seven times while accompanied by a lawyer from HRINFO, among the members of the defense team, for five times. Our lawyer has monitored the unlawful measures taken against the suspect and the violations against their right to a fair trial, e.g.:
- Inducing the accused to refuse legal aid from human rights organizations.
- Denying the accused and their lawyer to have full account neither of the complaint filed against them nor of the investigation record.
- Deliberately, inflicting hardship upon the accused and their lawyer by extending the questioning sessions to late hours into the night.
- Denying the accused their right to make the deputy of state security take official notice of the loss or unavailability of a number of documents confiscated by the security services upon their arrest.
- Asking unlawful questions that violate the accused right to freedom of conscience e.g.: what do you think of? What is your personal stance regarding?
- Ignoring the fact that security services conducted a search inside a house belongs to a mother of one of the accused, without producing a search warrant.
"the public deputy must seek the truth behind the allegations of the security services and see whether it is true or false that the accused have broken the law, yet the questioning process proves the opposite, the public deputy is keen on reaching an indictment which renders the whole questioning process unlawful .HRINFO calls for an appointment of a judge to conduct the questioning in order to satisfy the justice" said Gamal Eid the executive director of HRINFO.
HRINFO decided to maintain its presence during the questioning process without ruling out the possibility to withdraw and also calls upon the other lawyers to withdraw collectively, in order to deprive this unlawful questioning from any shades of legality and justice which are concepts quite unfamiliar to the understanding of the deputy of state security.
