    Tunisia

    Prosecution of Citizens for their Thoughts and Political Views
    Tunisian Government continues to constrict the activity of political and rights institutions. Mr. Ali al-Arid, a leader in the Annahda Renaissance Movement have been subjected to detention for several hours at the headquarters of security forces in Tunisia, that have been warning him to refrain from any actions related to public work and communications with political parties, Mr. al-Arid was also threatened to be returned to prison. The security authorities considered that this summon as the last warning to him.

    Further to this the 8th Correctional Service Court Primary Court has sentenced 19 youths because of their ideas and political attitudes, accusing them of participating in reforming an unrecognized association., holding unauthorized meetings, and prepare a meeting place for holding unpermitted meetings, and printing materials deemed to disturb the public order.

    Saudi Arabia

    of workers from Asian nationalities
    Unlike Saudi labor regulations, which provide fines or business suspension and entire closures of companies that do not pay its workers’ salaries, or violating any of contractual obligations. The Labor court had punished 55 workers of Asian nationalities, when they filed a complaint to the Ministry of Labour that the company they were working for, required from them to work for an extra year, after their contracts expire, failed to pay their tickets to return to their homes, retained the equivalent of eight months of their wages, and withheld approval of exit visas to leave Saudi Arabia, the court coercively prolonged their stay in the country, left them destitute for months without any clear end for their issue in the horizon, instead of proceed the company violations.

    Court Trial For criticizing the Propagation of Virtue on the Internet
    In type of trials that represent an unambiguous violation of freedom of expression protected in the International Law, on 5th May, the Saudi Prosecution has accused Ra’if Badawy of "Establishing a website that offends Islam" which is an accusation used by the Saudi government to silence its critics ", while the actual use of the site was for disseminating the details of the violations committed by the Promotion of Virtue and Suppression of the Vice, calling into question the prevailing interpretation of Islamic religion. The prosecutor has referred the case to the court demanding a 5 years in prison and a fine of 3 million Saudi riyals (about 800 thousand US$), while the prosecution has failed to investigate the site hacking and the death threats directed to Badawy.

    Confrontations transmitted from Darfur to Khartoum
    5 years After United Nations and Human Rights Organizations warning of the consequences of the crisis in Darfur, and the Sudanese government pre-estimation events’ significance and attribution of their impact on external parties, the clashes between Sudanese forces and Darfur Justice and Equality Movement’s rebels moved from for the very first time from the western region to central Khartoum.     The Delegation of the Human Rights Organizations to meet with the Attorney General of the Criminal Court

    The Prosecutor General of the Criminal Court, Luis Moreno Ocampo- during his visit to Cairo- has met with a number of representatives from Egyptian and Sudanese and International Human Rights organizations.

    The consultative meeting- held on May 11, 2008, addressed information and opinion exchange on the latest updates on the activities of the Prosecutor General on the issue of Darfur. During the meeting the delegation of the organizations pushed on the necessity of the cooperation of all of the Arab governments and the Arab League with the prosecutor office to put pressure on the on the Sudanese government, to accept to surrender of the accused Ahmed Haround and the Janjaweed leader Ali Kushib who are wanted for tribunal.

    The meeting reviewed the activities of the NGOs campaign for justice in Darfur, which was announced in April 2008 and includes 30 Arab and international organizations, and revitalize the Tribunal communication with Arab public opinion and Arab mass media.

    The Conclusion of a Workshop on Darfur Crisis
    On 9th May, 2008, the Cairo Center for Human Rights Studies has concluded the third training workshop on Darfur crisis and the International Criminal Court, which was attended by experts from Sudan, the Institute for Justice and Reconciliation, Netherlands, and a team of the International Criminal Court.

    Syria

    Abduction of Writer and Dissident Habib Saleh
    Continuing in the approach the Syrian government of abducting opponents and human rights activists by the Syrian security services, on the ninth of May,2008, the security agency had arrested the Syrian writer and dissident Habib Saleh, while he was walking around the Tartous Markets, and took him to an unknown place, disallow any news about him since his arrest until now. However his arrest believed to be related to some articles published by a few Websites that are censored by the Syrian authorities. Habib Saleh was arrested twice in the past, and spent a total of twenty-seven months in prison because of his legitimate activities in the field of human rights. In 2002, a sentence was handed down against him to imprisonment for three years, and was released on the ninth of September 2004.

    Fifteenth of August 2006, he was sentenced to another three years after accusing the Syrian government of corruption, tyranny and disrespect of human rights. He was released on 12th of September 2007.

    Iraq

    In shade of impunity to take responsibility for attacks on journalists and media workers, Press Freedoms Observatory announced the launch of a black list includes the names of those who attack or assault the journalists, the list will be in (Arabic, Kurdish, and English languages) and will be unevenly distributed to the rights and international organizations.

    Upon the launch of campaign- coordinating with the media outlets- the news and activities media coverage will not include the characters whose names are on the list.

    This week marked with the assault of Safaa el-Issi, the reporter of Radio Sawa in Basra city, while attempting to cover Al Mirbad Festival activities, A senior Iraq Army officer has assaulted the cameraman of the French Press Agency in Basra during filming a location where an exploitive package was blown up.

    An Attack on Asuda Organization for Women Rights
    Unidentified gun men reportedly opened fire on a protection shelter, operated by (Asuda)orgnization which provided support for more than 470 women of the violence victims since 2002. A mother for three children was resident in the shelter was shot by three bullets, admitted to the hospital for treatment.

    Palestine

    The human rights organizations in Palestine condemned the former government’s violations of opinion and expression freedoms in Gaza, after cancellation of the alternatives (Badael) conference also ordered the investigation into the incident referred to, given its inherent prejudice of public liberties, and clarifying the reasons that led to halt the meeting in Gaza. The center confirms that the respect of rule of the law and the enforcement of its authority requires the protection of the fundamental freedoms, in particular the Palestinians’ right to peaceful assembly and opinion expression within the law.

    In, the Captive Club communiqué
    The Captive Barghouthi statement to the Palestinian people nationwide and diasporas on the 60 anniversary of the catastrophe was addressed, as an emphasis on upholding the right to return and discarding any prejudice to this right. He demanded in a press release that the Palestinian national and Islamic factions to work for unity and national reconciliation. Al-Barghouthi assured that the Palestinian people will not accept any resolution that decrease rights or prejudice his national principles, and ending the occupation and evacuating it from the territories occupied in 1967, establishing the independent State of Palestinian that has the full sovereignty on the borders of 4th June, and its capital to be Jerusalem, as well as guaranteeing the right of return for refugees in accordance with the international resolution no. 194 and all of the comprehensive release of all of the captives and detainees are the basics demands of any resolution to the conflict.

    Reporters without Borders condemns Hezbollah’s attacks on four media institutions belongs to Sa’d al-Hariri, Chairman of al-Mustakbal (Future) Trend.

    “Al-Mustakbal” (Future) Television- terrestrial and satellite TV, Satellite TV news channel, Future new t-Mustakbal” the Radio Orient were forced to stop broadcasting On May 9th, 2008, under the threat of Hezbollah Elements.

    “Lebanon is undergoing a serious political crisis and the situation is very disturbing,” the press freedom organization said. “We hope the gagging of the anti-Syrian parliamentary majority’s news media is not a harbinger of even greater violence. The aggressiveness displayed by Hezbollah militants poses an additional danger for the many journalists covering the clashes on the streets of Beirut. We urge Hezbollah to refrain from attacks on the press.” announced the organization.

    Palestinian Association for Human Rights(Rasid)
    Strongly condemns the increasing attacks against journalists and some media workers and media institutions in Lebanon by armed elements of the Lebanese opposition in the shade of the dispute between the opposition supporters on one side and supporters of the Lebanese government on another. The Palestinian Association for Human Rights (Rasid) calls on the disputant parties, especially the leadership Hezbollah and Amal Movement to take serious steps to stop such attacks and prevent their reoccurrence, which conform a serious breach on the sanctity of freedoms of opinion and expression and the right to circulation and exchange of information. (Rasid) also stresses that the right to enjoy the freedoms of opinion and expression and the right to exchange and circulating the information is an essential pillar of any democratic system.

    Egyptian Authorities use intimidation and violence to suppress Internet activists included the Human Rights Watch’s communiqué
    Demanded Human Rights, the Egyptian authorities to conduct an immediate investigation and to bring to court the security officers responsible for assaulting Mr. Ahmed Maher Ibrahim, a 27-year-old civil engineer, used a social-networking site on the Internet (Face book) to support the calls for organizing a public strike in Egypt on May 4, 2008, which coincided the President Hosni Mubarak’s 80th birthday.

    “Maher told Human Rights Watch that officers from the Interior Ministry’s State Security Investigations (SSI) department apprehended him on a street in the suburb of New Cairo on May 7, blindfolded him and took him to a police station where they stripped him naked, and beat him intermittently for 12 hours before releasing him without charge” The activist also told the BBC Radio that if he stops his work he would consider himself a partner in the regime crimes.

    In a statement, the Arab Foundation for Human Rights
    The foundation watched concernedly the security forces who prevented engineers from protest within their syndicate in Cairo on Saturday 10/5/2008. The Assembly of “Engineers against Guard” called on engineers to sit in at their syndicate in Cairo, protesting the obstruction of putting to force the Administrative Judiciary Court sentence issued on 3rd of February, 2003, which required the judiciary committee supervising the professional syndicates election to call on for reopening the nomination for the election proceeding which has been under guard since 1995.

    At the other side, the foundation expresses its conviction of the Damietta security agencies’ arrest of Dr. Ahmed El Biely, the Committee for Defending the Environment Member, and Dr. Hassan El Morsi the member of the committee for coordination between the professional syndicates in Damietta governorate after the press conference held last Friday 9/5/2008, at the doctors syndicate in Ras Al Bar protesting establishing of environment polluting Agrium Factory, where Damietta is witnessing a number of the anti-project actions those were undertaken by the syndicates and civil society associations against the existence of this factory on the governorate land.

    The International Criminal Court Prosecutor General met with a delegation of Egyptian, Sudanese and International organizations.
    A delegation of Egyptian and Sudanese and international human rights organization held a consultative meeting with the Prosecutor of the ICC, Mr. / Luis Moreno - Ocampo in Cairo on May 10, 2008, as a part of his recent visit to the Arabian area, information and views about the latest work of the prosecutor general on Darfur issue were exchanged. Participated organizations stressed on the necessity of governments and the Arab League cooperation with the Office of the Prosecutor General, to put pressure on the Sudanese government to accept the extradition of suspects wanted for trial, further to this, the meeting parties reviewed the activities of the NGOs campaign for justice in Darfur announced in April 2008, including 30 international and Arab organization.

    A number of practical proposals were addressed in the meeting, to reactivate the inter-connections of the court and the Arab public opinion and mass media.

    This meeting was attended by representatives from the Cairo Center for Human Rights Studies, Egyptian Initiatives for Personal Rights, Arab Center for Judiciary and Advocacy Independence, Andalus Center for Tolerance and Anti Violence Studies, Sudanese Observatory for Human Rights, Khatim Adlan Center for Development in Sudan, International Coalition of the International Criminal Court and International Federal for Human Rights.

    Achieving Equality between Men and Women in Euro-Mediterranean Region is a Humanitarian and Rights Demand Governments in Arab States and European group are required to meet shoulder their responsibilities seriously to achieve equality through implementation of the Istanbul Plan of Action.

    “ Promotion of women rights is a significant indication for democratic reform in the area.” said Kamal Gandoubi the head of the network, in the opening speech of the Regional Planning and Coordination about Istanbul Plan of Action, organized by the Euro-Mediterranean Network for Human Rights, on 11th May, 2008 in Cairo, in cooperation with Cairo Center for Human Rights.

    The meeting aimed to shed the light on the importance of Istanbul Plan of Action in supporting the women rights and equality in the Euro-Mediterranean area.

    CEDAW implementation malfunction, Convention against all Forms of Discrimination Against Women, limited women participation in the public life, existence of discriminative law provisions against women, Gender Based Violence against Women, and Violence against Immigrant Women.

    They have also required the Arab governments in general and the Egyptian government in particular to participate in Barcelona Rout and European Neighborhood Policy, which was signed with the European Union, and to open the dialogue with civil community organization, and human rights organization who stand as real ally in implementing the corrections needed by the Arab nations and societies towards the political, social, cultural, and economical development”

    “North Cairo 14th Criminal Directorate at the Abassya court has accepted the appeal of the Interior Minister in form and but subjectively rejected it, in regard of the arrest order against Sinai’s activist Musa'ad Suleiman Hassan, known as Musa'ad Abu Fagr. The Minister of the Interior order of arrest came in the background of Sinai events, where the prosecution charged Musa'ad on 26/12/2007 of gathering and demonstration through the Prosecutor General office, which has ordered Musa'ad to be detained reservedly, then the decision was appealed before the courts who decided his release, last one was on 16/2/2008, even so the Minister of Interior did not release him, and he issued an order to arrest him since that date, placed in al-Arab Tower, classified as criminal detainee. So Musa'ad went in a hunger strike demanding to be classified as political prisoner.

    At this point the center filed a complaint about the detention, and the court ended up with detention annulment decision, but the minister of interior has appealed the decision at the criminal court which confirmed the decision of the first-degree court, rejecting the appeal of the interior minister. Thus Musa'ad has the right to be free, unless the minister of interior issued a new arrest order against him. Welcoming the Criminal court decision the center is demanding the minister of interior to implement the decision of the court and the release of Musa'ad and no more arrest orders to be issued.

In the Statement of 14 Egyptian Rights Organization Demanding the Egyptian authorities and members of the People Assembly to put an end to the extraordinary era of emergency, which has afflicted Egypt over twenty-seven years uninterruptedly, and to refrain from renewing the state of emergency which will expire on May 31st, 2008, even if the government had not yet completed the preparation of additional legislation to combat Terrorism, it will be based on a merger between the special powers enjoyed by the executive authority under the emergency law, and the notorious amendments to the Penal Code and Criminal Procedure, under the pretext of combating terrorism, according to the Law No. 97 for the year 1992. Egyptian Organizations ensure their absolute dismissal to use the terrorism scarecrow, whether to give kind of legitimacy to renew the emergency law once again, or enact new legislation to combat terrorism, that transform the temporary state of emergency - at least in theory – to an eternal state.

    These organizations emphasize that the continued state of emergency throughout this era is incompatible with the norms of international law, which allowed the imposition of a state of emergency to face the imminent threat elements identified in the case of war or the threat of, or cases of natural disasters, moreover to maintain the exceptional state as a pretext of combating terrorism, was in deficiency to any of the substantial foundation for many years, especially after the risks of terrorist activities were drawn back – to a far extent - after the involved groups in those crimes went proceeded to a significant point in revising, and it severed groups involved in these crimes criticizing the jurisprudential grounds their crimes were based on.

    Egyptian organizations reassure their argument, about the requirements of combating the terrorism phenomena, or even political and social violence should not be placed in conflict with the requirements of protecting human rights, and confronting these phenomena will not manage to succeed through the tight security operations that disregard the human rights. It requires at the first place, political resolutions based on objective diagnosis of the issues of political, cultural, economical and social roots, those induce such phenomena. Hence resolving the terrorism and violence acts will be subject to availability of a democratic atmosphere, that guarantee real opportunities of expression, opinion and ideas exchange in full freedom, opens a space for an actual community participation in policy making.

    The signatory organization of this statement warn of backing the emergency state whether by the through the emergency law or the anti-terrorism law, which creates a favorable environment for the violence and terrorism phenomena growth, especially regarding the article 179 that forced into the constitution last year, which had paved the way for settlement of the police state, through offering extraordinary powers to the executive authorities and its security agencies, of the Elements of the state police, through the offer of executive power and its security organs of the extraordinary powers that override the constitutional guarantees under articles 41, 44, 45 of the Constitution, which protect the rights of citizens to personal freedom and safety, and prohibits raiding and inspecting their homes or watching their messages or listening over their phones, without prior judicial authorization, as well as what granted by Article 179 of the powers that allow the president as the head of the executive authority to deprive suspects and defendants in terrorism cases from appearing before their natural judge, refer them to emergency judiciary, including the military judiciary, which denies its prosecuted several legal and procedural guarantees, what considered as serious breach of the fair trial standards.

    Organization Statement about the students detained on the background of Moulay Ismail University -Meknes Events

    according to the Moroccan Organization for Human Rights statement, it has held a meeting with the Attorney General of the Meknes Appeal Court and the manager of the local prison in regard to the issue of local students who were arrested on the background of the events of Moulay Ismail University in June 2007.

    The organization had requested an appointment with the Attorney General of the king and director of the local prison, following to the student hunger strike, which was dissolved before the meeting.

    The Organization representatives had addressed the implementation of the students demand and in particular those related to:
    • Resuming their study in normal conditions and allowing the access to references and books.
    • Inquiry about the circumstances of their trail postponing, as well as stressing on securing fair trial requirements.

    In another context, Human Rights Watch Organization said that the Moroccan government should open the investigations immediately into the allegations of skinning a boat into the Mediterranean Sea by the Moroccan Naval Forces, and resulting 28 immigrants to be drowned.

    According to “El País” ,Spanish newspaper May 7th issue, that one of the naval elements had punctured the boat by his knife, what released air of the boat.
    “We begged them to regard our babies and our children..but the soldier stabbed the boat, and stood watching us with fixed arms.” Said one of the survivors to" El País" the Spanish newspaper.

    “The Moroccan authorities need to investigate properly to find out what really happened,” said Bill Frelick, refugee policy director at Human Rights Watch. “If Moroccan sailors caused the boat to sink and allowed its passengers to drown, they should be prosecuted.”

    Abduction of the Head of the Moroccan Human Rights- Ayoun Branch
    On 10th May, 2008, the Ayoun/Western Sahara Moroccan police has abducted the Sahrawi human rights defender Hamoud Iguilid, the president of Laayoune Section of the Moroccan Association for Human Rights- Layoun Section, and Saharan Human Rights Defenders Assembly Secretariat Member. The abduction of “Hamoud Iguilid” took place around 8 PM, by the agents of the Police dressing in civilian form, and affiliate with the so called Anti-Riot Division of Alayoun/Western Sahara, and moved him to an unknown location.

    A Statement of the National Corporation for Defending Rights and Freedoms
    The political security Arrest the Journalist Ba Gharib in the midst of his colleague at the quarters of October 14th Foundation-Aden

    The statement included: “In an expected step the political security arrested the colleague Nasr Bagharib the member of the Yemeni Journalist Syndicate, the Editor Secretary of the Yemeni News Agency “Saba” and that was on Sunday, at the quarters of the 14th of October Foundation for Press, Printing and Publishing, in al-M’aala province, surprising many of his colleagues journalists, the Yemeni Journalists Syndicate convicted the arrest and demanded his release.
    The Press Prosecution Summons 6 of the Al Wahdawi Journalists, while the Newspaper believes this action to in the framework of the authorities’ orientation to suppress the freedoms.

    A Newspaper belongs to one of the opposition parties in Yemen, reported that it has received on the Sunday evening six summons from the Press and Publications Prosecutor to the editor-in-chief, editorial manager, and a number of its editors on the background of a publishing issue was not identified in the summons.
    According to al-Wahdawi, each of the editor-in-chief Ali Assaqaf, and the editorial manager will appear before Amana South-West Court, in –so far- unidentified publishing claims. The newspaper considered this summons in the framework of the authorities’ policies to suppress the freedoms, and target the truthful freedom, and an attempt to conceal the corruption. The editorial committee of “Al-Wahdawi” called on the Journalist Syndicate, the Journalists midst, and the rights organization to consolidate with her to confront the authority targeting of the press freedom and right of expression.

    The Arabic Network for Human Rights Information

    “The website of the Egyptian Movement for change http://harakamasria.org was blocked from the internet users in Egypt, who are connected to the internet through the T-Data company, the nation largest Internet provider company in Egypt, and controlled by the Egyptian government since May 4th.” Said the Arabic Network for Human Rights and Added: “Many of Kefaya popular site visitors, were surprised finding themselves unable to browse the site during the call for the 4th of May strike, whether through “T-Data” company or “Link” company, while the Link company has unblocked the site later, “T-Data” which belong to the Egyptian government did not lift the ban on the site until today. It was a shocking time for the Egyptian government to block the site while hosting the “Telecom Africa Conference” the largest telecommunication conference in the same period.

    The Arabic Network strongly condemned the decision of the ban on Kefaya web site, demanding the government to correct this mistake immediately, through lifting the ban on Kefaya and stoppage of harassing the Internet activists in Egypt.

    The Rights Institutions who defend the Opinion and Expression and Press Freedoms in Egypt, the members of the International Freedom of Expression Exchange Network “IFEX”, Arabic Network for Human Rights Information, Egyptian Organization for Human Rights, and Cairo Center for Human Rights Studies are motivated by their belief in the importance of supporting the journalists against the violations they are exposed to, and the abuses threaten the Press Freedom. Considering the numerous important events related to Press Freedom took place in May, in particular the Appeal Session on 3rd May of the lawsuit against the Editors in chief that which coincided with the Press Freedom International Day, moreover the Appeal Session of Mr. Ibrahim Issa, editor-in-chief of Addustour Newspaper on May 18th.
